DMCA Policy

Frittata respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website, Frittata will respond expeditiously to claims of copyright infringement committed using the Frittata service and/or the Frittata website (the "Site") if such claims are reported to Frittata's Designated Copyright Agent identified below.

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Site by completing the following DMCA Notice of Alleged Infringement and delivering it to Frittata's Designated Copyright Agent.

Filing a DMCA Takedown Notice

To file a DMCA takedown notice, please provide our Copyright Agent with the following information in writing:

  1. Identification of the copyrighted work claimed to have been infringed: This must include a detailed description of the work and, if possible, a URL or other reference to where the work is published or located.
  2. Identification of the material that is claimed to be infringing: This must include a detailed description of the material and information sufficient to permit Frittata to locate the material on the Site (e.g., a URL to the specific content on Frittata).
  3. Information to allow us to contact the complaining party: This includes your name, address, telephone number, and, if available, an email address.
  4. A statement that the complaining party has a good faith belief: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. A physical or electronic signature: A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright that has been allegedly infringed.

Filing a DMCA Counter-Notification

If you believe that your content was removed or disabled by mistake or misidentification, you may send a counter-notification to our Designated Copyright Agent containing the following information:

  • Identification of the material that has been removed: This must include the specific location (e.g., URL) at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the U.S., for any judicial district in which Frittata may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Your physical or electronic signature.
